1. Introduction

As medical cannabis programs have varying regulations from state to state, we’ve compiled an in-depth guide with everything you need to know about medical marijuana reciprocity in the United States.

 

1.1. Obtaining or Renewing Your Medical Marijuana License

2. Medical Marijuana Reciprocity

A total of 36 US states plus Washington DC, Guam, Puerto Rico, and the US Virgin Islands currently have medical marijuana programs. 11 out of these 36 states, including Washington DC, Puerto Rico, and the US Virgin Islands, currently offer medical marijuana program reciprocity for state licensed medical cannabis ID cardholders (or equivalent). 

The rules surrounding reciprocity vary from state to state. Some states require a “visitor application” prior to traveling, others require you to sign paperwork inside a local dispensary, or they may simply ask for your medical marijuana license / proof of identity before making a purchase at a dispensary.

Please note some states have limitations on cannabis products available for medical marijuana patients. For example, cannabis infused sweets such as cookies or smokable flower may not be permitted for medical patients in some locations.

 

2.1. Which States Accept Out-of-State Medical Marijuana Licenses?

Medical marijuana patient reciprocity in the United States is currently allowed in ArizonaArkansas, Hawaii, Maine, Michigan, Nevada, New Hampshire, New Mexico, Oklahoma, Puerto Rico, Rhode Island, Utah, and Washington DC. Patients must typically provide an active state licensed medical marijuana card and ID (proof of identity) to be eligible.

 

Arizona

Visiting patients with an active state medical marijuana card or equivalent from their home state may possess and use medical marijuana in Arizona. Qualified non-residents can possess/consume up to one ounce of usable marijuana. Please note that you cannot make purchases at Arizona licensed dispensaries.

Arkansas

Non-residents must apply as a visiting patient before being able to purchase medical marijuana in Arkansas, and must hold a medical marijuana card or equivalent from their home state. Applications cost $50 and may take up to 14 business days for processing. If approved, visiting patients have a 30-day window during which they may purchase medical marijuana in Arkansas.

Please note that even though medical marijuana delivery is offered by dispensaries in Arkansas, since the product has to be delivered to the address listed on your medical marijuana license, which will be an out of state address, you will not be eligible for delivery. Hawaii

Non-resident adult and minor medical marijuana patients (along with their caregiver/legal guardian) with an active state government issued medical cannabis card can apply for Hawaii’s “out-of-state patient program.” This program allows visiting patients to possess, consume, and make purchases at Hawaii licensed medical marijuana dispensaries. Registered out of state patients may purchase/possess up to four ounces every two weeks.

For adult patients, a state ID or driver’s license is required to apply (passports or military cards not accepted). Your cannabis card / state ID or driver’s license must both be from the same state. Medical marijuana physician authorizations do not qualify in replacement of a state licensed medical marijuana card. The online application takes approximately ten minutes to complete. Out of state residents are allowed to apply for up to two 60-day terms in one calendar year. A start date for each term can be requested, and applicants can apply up to 60 days before the start date. Applications incur a fee of $49.50.

  3. Pay the non-refundable $49.50 application fee.
  4. Hawaii State Department of Health reviews application. If approved, you will receive a confirmation email with next steps.
  5. Log into the portal to download & print your registration card.

Michigan

Anyone with an active state licensed medical marijuana card (cannot be expired) and proof of identity (ID) can purchase medical marijuana in Michigan, but it is at the discretion of each dispensary. Make sure to double check with your dispensary of choice to see if they allow out-of-state patients. The possession/purchase limit is 2.5 ounces of cannabis. Medical marijuana taxes, for both in and out of state cardholders, incur a 6% sales tax.

Unfortunately, out of state medical marijuana patients cannot order medical marijuana using delivery services in Michigan, as the delivery address has to match the address on the medical cannabis card. If you wish to use cannabis delivery, recreational dispensaries are a valid option.

New Hampshire

New Hampshire has limited reciprocity, meaning that qualified visitors may possess up to two ounces of usable cannabis (or the equivalent in infused products). In order to qualify, visitors must provide a note from their medical provider stating they have a qualified medical condition (as defined by New Hampshire law) and show proof of an active state-issued medical marijuana registry card. Please note that purchasing medical marijuana from a dispensary as a visitor is not permitted.

With new laws in progress, make sure to double check the Therapeutic Cannabis Program website, call their office at (603) 271-9333, or email tcp@dhhs.nh.gov to confirm the most up to date regulations.

 

New Mexico

Patients with an active state-issued medical marijuana registry card and driver's license / ID (all from the same state) may apply for a “reciprocity license” at a qualifying dispensary in New Mexico. Dispensaries must be registered to provide reciprocity licenses, so make sure to call and double check before heading to your dispensary of choice that this service is offered.

To obtain a reciprocal license to purchase tax-free medical marijuana in New Mexico, you will need to fill out paperwork at a licensed dispensary. Possession and purchase limits of medical marijuana are the same for both in-state and non-resident visiting patients. The purchase limit is 230 units every 90 days (8 ounces of dried cannabis flower). One unit equates to 200 milligrams of edibles, topicals, or tinctures.

Oklahoma

Great news! US state licensed medical marijuana card holders, as well as minor patients, are eligible to apply for an Oklahoma temporary patient ID. Having this temporary ID allows for visitors to legally buy, use, and grow their own marijuana in Oklahoma for 30 days. 

Following acceptance, you will receive a temporary patient identification card. Oklahoma possession limits are the same for both in and out of state medical marijuana card holders. You may possess up to three ounces of medical marijuana, and home grow up to six mature marijuana plants + six seedlings.

Licensed out of state medical marijuana patients, caregivers, or patients’ legal representatives must submit an “authorization to disclose patient information” form in order to become a temporary medical marijuana patient in Oklahoma.

 

Temporary Patient Application Requirements:

  1. Create an account on omma.ok.gov using a valid email address. Future correspondence will occur via email.
  2. Upload a portrait photo in color showing full face/head/top of shoulders against plain white or off-white background to be used for the temporary patient ID. Must have a neutral expression with a closed mouth or natural smile. Digital photos must be in .jpg, .png or .gif format and no larger than 3 MB in size. Photos must be taken within the last six months to reflect current appearance. Remove eyeglasses before taking photos. Printed photos are not accepted.   3. Submit proof of identity i.e. state-issued driver’s license, state-issued identification card, US passport, tribal identification card, certified copy of birth certificate with seal/watermark visible for minors, or other photo identification issued by the U.S government.
  4. Submit a digital color copy of out of state medical marijuana license. Must show the front and back of the license
  5. Pay a non-refundable application fee of $100 + credit card processing fee. Visa, Mastercard, or Discover credit/debit card accepted. If denied, the application fee will not be refunded.

The Oklahoma Medical Marijuana Authority (OMMA) typically reviews applications within 14 business days of submission.

 

Temporary Minor Patients

The application for temporary minor patients requires a parent/legal guardian to fill out information and provide proof of identity along with the minor patient’s information. Minor patients are not allowed to enter a dispensary without their parent/legal guardian present. Temporary minor licenses are also valid for 30 days.

Please note that an Oklahoma temporary license cannot exceed the expiration date of your out of state medical marijuana license. Upon expiration of the temporary license, you must submit a new application. Applications may be submitted up to one week prior to the expiration date of the current temporary license.

Puerto Rico

If you’re headed to Puerto Rico as a US medical marijuana patient/card holder, you're in luck! Puerto Rico allows for medical marijuana reciprocity with a valid state licensed medical marijuana card. You will need to register at a local dispensary upon arrival and show proof of your state medical marijuana ID card. 

Please note that visiting patients are not allowed to buy dried marijuana flower. Purchase of medical marijuana cartridges or infused products is permitted.

Rhode Island

Rhode Island offers full reciprocity for out of state medical marijuana card holders in the US. Visit a Rhode Island licensed medical marijuana dispensary with your government issued ID + state medical marijuana card to register as an out of state patient. Both in and out of state medical marijuana patients can purchase up to 70 grams of medical cannabis every 15 days.

Please note that you cannot use your phone inside Rhode Island medical marijuana dispensaries.

Utah

Medical marijuana patients, as well as minor patients with a parent/legal guardian, who are visiting Utah with a qualifying condition (as defined by Utah), and hold an active state medical cannabis card may apply for a “non-Utah resident card.” Utah residents who have been in the state for less than 45 days may also apply for a non-Utah resident card.

This card allows qualified visiting patients and new Utah residents to purchase cannabis at licensed dispensaries in Utah over a 21 day period. Non-Utah resident card applications are processed online for approval. Visiting patients are permitted up to two 21 day non-Utah resident cards per calendar year. 

Please note that smoking marijuana is not permitted in Utah along with sugary edibles such as cookies, brownies, or candies. Alternatively, devices that warm cannabis into a vapor without the use of a flame (such as vaping) are allowed. Possession limits are 113 grams of flower and cannabis products that contain no more than 20 grams of total composite THC.

Non-residents may also possess and use medical cannabis products purchased from outside of Utah as long as they are within the legal possession limits as defined above. Medical cannabis obtained in Utah must be purchased from Utah-licensed medical marijuana pharmacies.

  • Terminal illness with 6 months or less life expectancy

For individuals with conditions not listed above, the Utah Compassionate Use Board accepts petitions for a medical cannabis card.



How To Apply For a Non-Utah Resident Card

  1. Create an account at evs.utah.gov
  2. Click on “Patient Registration”
  3. Select “Non-Utah Resident” under registration type & fill out requested information.
  4. Next click on Tracking Inbox > Patient > New Patient
  5. Fill out requested information & upload a copy of your current out of state medical marijuana card.
  6. Once completed, pay the $15 application fee.
  7. Click on the “Patient” tab and confirm your updated status.
  8. Email your dates of travel to medicalcannabis@utah.gov so that your card will be ready on time.

If done correctly, your application status should update to “Awaiting State Review” at the top of the portal. Applications are processed on a weekly basis. If approved, you will receive an email copy of your non-Utah resident cannabis card which can be printed or downloaded to a mobile phone.

2.2. States Without Medical Marijuana License Reciprocity

Although 36 US states currently have medical marijuana programs, some only allow for residents to be eligible and do not have any reciprocity with other states. The following states have medical marijuana programs strictly for residents only, and do now allow for reciprocity: Alabama, Alaska, California, Colorado, Connecticut, Delaware, Florida, Georgia, Guam, Illinois, Louisiana, Maryland, Massachusetts, Minnesota, Missouri, Montana, New Jersey, New York, North Dakota, Ohio, Oregon, Pennsylvania, South Dakota, Texas, Vermont, Virginia, Washington, and West Virginia. 

Alabama

  • Alabama’s medical cannabis program is still in the works, and there are currently no dispensaries open yet in the state. Medical marijuana business licenses are estimated to be issued starting from fall 2022. Alaska

  • Although Alaska does not allow for medical marijuana program reciprocity, recreational adult-use for individuals 21+ remains legal. Possession limits are up to one ounce of cannabis.

California

  • California does not allow for medical marijuana program reciprocity, but recreational adult-use for individuals 21+ remains legal. Possession limits are up to 28.5 grams of marijuana.

Colorado

  • Colorado does not allow for medical marijuana program reciprocity, but recreational adult-use for individuals 21+ remains legal. Adults may possess up to two ounces at any one given time.

Connecticut

  • Connecticut does not allow for medical marijuana program reciprocity, but recreational adult-use for individuals 21+ remains legal. Adults may possess up to 1.5 ounces at any one given time.

Delaware

  • While recreational use remains illegal, possession of small amounts is decriminalized. Possessing less than one ounce of marijuana as an adult 21+ will incur a maximum civil penalty of $100 and is not a recorded offense.

Florida

  • Both out of state medical marijuana reciprocity and recreational marijuana are not legal in Florida at this time.

Georgia

  • Although reciprocity is not allowed, the Georgia Department of Health states that “valid registration card holders of low THC oil who have been in Georgia for less than 45 days may be eligible.” Please note that the Georgia medical marijuana program is still in the works and low THC oil is not yet available. Guam

  • Guam does not allow for medical marijuana program reciprocity, but recreational adult-use for individuals 21+ remains legal. Adults may possess up to one ounce of bud at any one given time and may home grow up to three flowering + three non-flowering marijuana plants.

Illinois

  • Does not recognize state to state reciprocity, but recreational adult-use for individuals 21+ remains legal. Adults may purchase/possess cannabis in varying amounts depending on whether you are a resident or not. 
  • Illinois residents may purchase/possess up to 30 grams of cannabis, 500 milligrams of THC infused products, and five grams of cannabis concentrates. 
  • Non-residents may purchase/possess up to 15 grams of cannabis, 250 milligrams of THC infused products, and 2.5 grams of cannabis concentrates. 

Louisiana

  • Although recreational use is not legal, possession of up to 14 grams of cannabis is decriminalized, with a maximum of a $100 fine and no jail time.

Maryland

3. Can I Take My Medical Marijuana Across State Lines?

Under federal law, marijuana that has a THC content higher than .3% is categorized as a “Schedule I” substance, and is illegal to possess, use, grow, or distribute. Taking marijuana across state borders is considered a federal crime. 

Cannabis flower, infused products, and some CBD products are illegal to possess on federal property, during air transportation, or when traveling from state to state. Only products with up to .3% THC on a “dry weight basis” are permitted, as noted by the Transportation Security Administration (TSA).
